PNB Foreclosed Properties In Negros Oriental For Sealed Bidding On April 22, 2015

Sealed Bidding Terms of Reference

I also received a copy of the sealed bidding terms of reference, which I am sharing below. This should give interested bidders a clear picture of the bidding process.

Note: Interested bidders will have to submit a signed copy of this form.

1. For purposes of definition, the highest complying bid is the complying bid with the highest net proceeds to the Bank. 1

2. Sale of the property on an “As-Is, Where-Is” basis. 2

3. Sale is in accordance with the terms and conditions specified in the PNB Purchase Proposal.

4. Sealed offer/s must be placed in an envelope containing the following:

a) Filled up Bank-prescribed “Purchase Proposal Form” accompanied by a Buyer’s Information Sheet. If a bidder is a representative of a corporation, the representative must submit a Secretary’s Certificate to represent the said corporation.

b) Sealed offer/s to buy must be accompanied by non-interest bearing deposit of at least 10% of the offered purchase price in the form of Cash or Cashier’s/Manager’s Check payable to the Philippine National Bank.

c) Proof of income such as Certificate of Employment, Income Tax Return and other audited financial statements should be included in the sealed envelope if payment of the bid price is on installment basis.

5. As a general rule “No bid below the floor price shall be accepted”.

6. No withdrawal of bids shall be allowed once the bid has been submitted. Any withdrawal of bid shall result to forfeiture by PNB of deposit. Upon selection of the highest complying bid, all non-winning offers including the deposit shall be returned accordingly.

7. In case two or more highest complying Price bids are identical, the following shall be considered:

  • The bid on cash basis shall be considered as the winning complying bid
  • If all bids are on installment basis, the bid with the least number of years for installment payments will be acknowledged as the winning complying bid
  • If two or more bids are identical in amount and terms, a private sealed bidding shall be conducted on the next working day

8. In the event that the highest complying bidder fails to comply with the specified payment terms on the Purchase Proposal, the 10% deposit shall be forfeited as penalty.

9. PNB reserves the right to reject any and all bids at its sole discretion, waive any defects or informality on the bids received and accepts the bid most advantageous to PNB but does not guarantee that any award shall be made.

10. PNB does not assume any obligation whatsoever to compensate or indemnify any bidder for any expense that may be incurred in the bidding process.

11. PNB reserves the right to withdraw the foregoing property at any time before the deadline of submission of bids.

12. PNB’s decision is final and binding.


1Net proceeds to the Bank is defined as the Price bid less any applicable commissions if there is a broker/referrer indicated in the Purchase Proposal Form.
2Sale of property on an “As-Is, Where-Is” basis refers not only to the property’s physical condition, but also the condition of the title, the extent and state of whatever rights, interest, and participation over the property PNB may have at the time of offer to sell. In addition, “As-Is, Where-Is” shall mean to include the buyer’s assumption of any and all claims, liens, assessments, liabilities and/or damages arising from any suit/litigation involving the property, accruing from the signing date of the Contract to Sell and/or Deed of Absolute Sale to the total exclusion of PNB.


Bidding Details

* Acceptance of bids will be on April 22, 2015, 2:00 PM , at PNB Dumaguete Branch.
* The winning bidder shall be based on the complying bid with the highest net proceeds to the Bank and in accordance with the Terms of Reference
* Sale is in accordance with the terms and conditions specified in the PNB Purchase Proposal
* In the event that the highest complying bidder fails to comply with the specified payment terms on the Purchase Proposal, the deposit shall be forfeited as penalty

General guidelines

Since a lot of people keep asking questions about the process of buying Pag IBIG foreclosed properties, I am including a copy of the guidelines below because most answers are found here.

GENERAL GUIDELINES

1. Interested parties are required to secure copies of: (a) INSTRUCTION TO BIDDERS (HQP-AAF-104) and (b) OFFER TO BID (HQP-AAF-103) from the office of the Acquired Assets Management at 7th Flr. JELP Business Solutions Center, 409 Shaw Blvd. Mandaluyong City or may download the forms at www.pagibigfund.gov.ph (link Disposition of Acquired Assets for Public Auction).

2. Properties shall be sold on an “AS IS, WHERE IS” basis.

3. All interested buyers are encouraged to inspect the property/ies before tendering their offer/s. The list of the properties may be viewed at www.pagibigfund.gov.ph/aa/aa.aspx (Other properties for sale-Disposition of Acquired Assets for Public Auction).

4. Bidders are also encouraged to visit our website, www.pagibigfund.gov.ph/aa/aa.aspx five (5) days prior the actual auction date, to check whether there are any erratum posted on the list of properties posted under the sealed public auction.

5. Sealed proposals shall be received by the Committee on Disposition of Acquired Assets’ Secretariat at 7th Flr. Conference Room JELP Business Solutions Center, 409 Shaw Blvd. Mandaluyong City, starting 9:00 AM but not later than 12:00 NN on the scheduled date; the said proposals shall be opened immediately in the presence of the committee and attending bidders. Bidders are advised to submit their proposals only on the scheduled date of batch. No proposals shall be accepted by the committee earlier or later than the scheduled date.

6. The Bid Offer shall not be lower than the minimum bid set by the Fund.

7. Each bid proposal shall be accompanied by a BIDDER’S BOND either in CASH or MANAGER’S CHECK issued by any commercial bank, payable to Pag-IBIG FUND, for an amount equivalent to 10% of the BID PRICE. It shall likewise serve as the down payment of the winning bidder.

8. Payment of the remaining ninety percent (90%) bid offer balance may either be thru any of the following modes:

a. Cash – on which the approved purchase price shall be paid not later than thirty (30) calendar days from date of receipt of Notice of Award (NOA).

b. Installment basis – on which payment shall be in equal monthly installment inclusive of 12% interest per annum and provided the chosen payment term shall not exceed twelve (12) months.

c. Pag-IBIG Housing Loan – payment shall be in the form of monthly amortization based on the approved loan term, which may be up to a maximum of thirty (30) years with the following considerations:

1.Loan approval and term shall be subject to eligibility requirements stipulated under the Pag-IBIG End-User Home Financing Program guidelines;

2.The loan amount shall be the bidder’s bid offer, net of the 10% downpayment;

3.In case the housing loan application has been disapproved, the 10% bidder’s bond shall be forfeited in favor of the Fund.

4.The buyer shall be required to file his Pag-IBIG housing loan application and pay the following incidental expenses within thirty (30) calendar days from receipt of the Notice of Approval of Sale:

a. Processing fee of Three Thousand Pesos (the P1,000.00 shall be paid on the auction day while the remaining P2,000.00 shall be paid upon submission of complete requirements);

b. Equity, if applicable;

c. One year advance insurance premiums (sales redemption insurance as well as fire and allied peril insurance);

5.In case the Bid Offer, net of the ten percent (10%) bid bond, is still higher than the appraisal value of the property, the amount in excess of the appraisal value shall be treated as equity. It shall be paid by the buyer within thirty (30) calendar days upon receipt of Notice of Loan Approval.

6.Original Borrowers who wish to participate on the Sealed Public Auction shall not be allowed to bid thru housing loan availment. They may only bid thru cash or installment basis.

9. The Bidders shall be present at the opening of bids. Bidders may designate their Authorized Representatives, provided they shall issue the following documents:

a. Special Power of Attorney for individual-bidder

b. Secretary’s Certificate for company-bidder

10. The Opening of Bids shall commence from 12:01 PM until completion.

11. The bidder who offers the highest bid shall be declared as the winner.

12. In case of a tied highest bid, it shall be resolved by applying the following order of preference:

a. Cash Offer (Mode of Payment);

b. Time of entry/registration in the auction room.
If there is still a tie, it shall be resolved immediately by an open auction between/among the tied highest bidders.

13. The non-winning bidders’ respective bid bonds shall be returned to them immediately together with an Acknowledgment Receipt once a winning bidder has been declared.

14. A public auction of Pag-IBIG foreclosed house and lots shall take place on May 13, 2015, at the 4th Floor, Conference Room, Pag-IBIG FUND Cagayan De Oro Branch, J. R. Borja Street, Cagayan De Oro City. Submission of bids shall be from 8:00AM to 12 PM only. Please refer to the complete list of properties, and general guidelines below.

This public auction includes properties that are mostly from Cagayan De Oro City and Opol. It also has one property each from Medina and Jasaan. All of these are within the province of Misamis Oriental.

I have included a copy of the general guidelines below in verbatim for quick and easy reference.

GENERAL GUIDELINES

1. Interested parties are required to secure copies of: (a) INSTRUCTION TO BIDDERS(HQP-AAF-104) and (b) OFFER TO BID (HQP-AAF-103) from the office of the Acquired Assets Unit at 2nd flr, Pag-IBIG Fund, Cagayan de Oro Branch, J.R. Borja st., Cagayan de Oro City.

2.The Invitation to Bid shall be published or advertised for not less than three(3) consecutive days in newspapers of general circulation, and posted on the 2nd flr Pag-IBIG Fund, Cagayan de Oro Branch, J.R. Borja st., Cagayan de Oro City.

3. Sealed proposal shall be submitted to Acquired Assets Section, Pag-IBIG Fund, Cagayan de Oro Branch starting at 8:00 AM but not later than 12:00 NN. No proposal shall be accepted by the the committee earlier or later than the scheduled date.

4. The Opening of Bids shall commence from 1:00PM to 5:00PM on May 13, 2015.

5. Purchase of the said property may be either on the following modes of payment:

a. Cash – on which the approved purchase price shall be paid not later than thirty (30) calendar days from date of receipt of Notive of Award(NOA)

b. Installment basis – on which payment shall be in equal monthly installment inclusive of interest and provided the chosen payment term, shall not exceed twelve (12) months.

c. Pag-IBIG Housing Loan -on which the buyer shall be required to file his Pag-IBIG housing loan application and pay incidental expenses within thirty(30) calendar days from receipt of the Notice of Approval of Sale.

6. The Minimum Bid shall be based on the appraisal value. The occupancy status on the ‘REMARKS’ portion is based on the condition of the property upon appraisal.

7. The Bidders shall be present at the opening of bids. Bidders may delegate their Authorized Representative. Provided they shall issue the following documents:

a. Special Power of Attorney for individual-bidder

b. Secretary’s Certificate for company-bidder

8. Each bid proposal shall be accompanied by a BIDDER’S BOND in CASH or MANAGER’S CHECK issued by any commercial bank, payable to Pag-IBIG FUND for an amount equivalent to 10% of the BID PRICE.

9. Properties shall be sold on an AS IS, WHERE IS basis.

10. If the winning bidder fails or refuses to push through with the purchase of the property, or fails to pay in full the remaining balance within 30 calendar days from receipt of the Notive of Award(NOA), he shall lose his right as winning bidder and the 10% bidder’s bond shall be forfeited in favor of the Fund.

11. All interested buyers are encouraged to inspect the said property before tendering their offers.

Pag-IBIG FUND RESERVES THE RIGHT TO REJECT ANY OR ALL BIDS. TO WAIVE ANY FORMALITY THEREIN OR ACCEPT SUCH BIDS AS MAY BE CONSIDERED MOST ADVANTAGEOUS TO THE FUND. THE DECISION OF THE FUND IS FINAL AND BINDING.
